If you are away from work for an extended period, you retain return rights to your position if:


  • Probationary period completed
  • Period of absence does not exceed a total of 180 calendar days of combined leave (sick, vacation and LWOP) or 90 calendar days LWOP, whichever comes first. (Union contracts may vary.) 
  • On approved Family Medical Leave (FMLA) - during the full FMLA period. 


Upon expiration of the period described above, the associate no longer has the right to immediately return to duty in the former position and band/tier/grade. If the associate is still unable to return to work, s/he may may remain in a leave without pay (LWOP) status for up to one year from the da
